{"id":35133,"date":"2025-10-14T17:03:48","date_gmt":"2025-10-14T17:03:48","guid":{"rendered":"https:\/\/cincinnatirighttolife.org\/?p=35133"},"modified":"2025-10-14T17:03:49","modified_gmt":"2025-10-14T17:03:49","slug":"pro-life-sanctuary-cities-arent-political-theater-theyre-actually-saving-lives","status":"publish","type":"post","link":"https:\/\/cincinnatirighttolife.org\/pro-life-sanctuary-cities-arent-political-theater-theyre-actually-saving-lives\/","title":{"rendered":"Pro-Life Sanctuary Cities Aren&#8217;t Political Theater, They&#8217;re Actually Saving Lives"},"content":{"rendered":"\n<p style=\"font-size:18px\"><strong><em>By:  Mark Lee Dickson, originally published <a href=\"https:\/\/thefederalist.com\/2025\/10\/03\/pro-life-sanctuary-cities-arent-political-theater-theyre-actually-saving-lives\/\" target=\"_blank\" rel=\"noreferrer noopener\">October 3, 2025, The Federalist<\/a><\/em><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center\" style=\"font-size:26px\"><strong>These city ordinances are not \u2018hollow gestures,\u2019 but real-world solutions that make an actual difference in the fight against abortion.<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\">n a recent opinion piece in The Hill titled&nbsp;<a href=\"https:\/\/thehill.com\/opinion\/campaign\/5486865-danville-illinois-abortion-pill-ban\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cWhen pro-life is reduced to political theater, everyone loses\u201d<\/a>&nbsp;Jacob Lane complains about his hometown of Danville, Illinois,&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-pills-ordinance-danville-illinois-a4bbda7fd47b76c2718470daf7bcbe13\" target=\"_blank\" rel=\"noreferrer noopener\">adopting<\/a>&nbsp;a Sanctuary Cities for the Unborn ordinance in May 2023.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The&nbsp;<a href=\"https:\/\/www.liveaction.org\/assets\/1749513422-danville-illinois-sanctuary-cities-ordinance-5-02-2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Danville Ordinance<\/a>, which I co-wrote with attorney&nbsp;<a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/us-politics\/jonathan-mitchell-attorney-trump-supreme-court-b2493362.html\" target=\"_blank\" rel=\"noreferrer noopener\">Jonathan F. Mitchell<\/a>, does not explicitly ban abortion, but simply requires compliance to the&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/1461\" target=\"_blank\" rel=\"noreferrer noopener\">Comstock Act<\/a>, federal statutes that prohibit the mailing or receiving of abortion-inducing drugs or abortion paraphernalia.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Referencing the Biden administration\u2019s Office of Legal Counsel&nbsp;<a href=\"https:\/\/www.justice.gov\/olc\/opinion\/application-comstock-act-mailing-prescription-drugs-can-be-used-abortions\" target=\"_blank\" rel=\"noreferrer noopener\">opinion<\/a>&nbsp;from December 2022, Lane dismisses Comstock, stating, \u201cThe Justice Department has already said Comstock doesn\u2019t apply when pills are shipped to states where abortion remains legal\u201d and claiming that Danville\u2019s ordinance was \u201cdead on arrival.\u201d Here, Lane pits himself against the wisdom of&nbsp;<a href=\"https:\/\/aul.org\/wp-content\/uploads\/2025\/01\/abortion-pill-policy_formatted_web-ready.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">leading pro-life organizations<\/a>&nbsp;and 20 state attorneys general who called the opinion a&nbsp;<a href=\"https:\/\/img1.wsimg.com\/blobby\/go\/76a46499-1c7d-4cf1-9747-a763a30f7232\/downloads\/66a0f45e-2ec5-499c-bc46-be5663412651\/2023-02-01-fda-rule---walgreens-letter-daniell.pdf?ver=1756141402449\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cbizarre interpretation.\u201d<\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Lane says, \u201cIllinois lawmakers have enshrined abortion as a fundamental right,\u201d and, \u201cNo city council can change that,\u201d disregarding that federal legislation trumps state laws and constitutions. No state can secure a right, privilege, or immunity to act in violation of federal criminal statutes as they are part of the \u201csupreme Law of the Land\u201d under Article VI of the Constitution.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Eighty-three cities and 11 counties across seven states have passed&nbsp;<a href=\"https:\/\/sanctuarycitiesfortheunborn.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sanctuary for the Unborn<\/a>&nbsp;ordinances. Each ordinance is written to go as far as we can possibly go, or in some cases as far as the city officials are willing to go, to protect unborn children and their pregnant mothers from the tragedy of abortion. Lane sees cities and counties that pass such measures to be \u201cexperimenting with laws that overstep their authority and distract from real policy fights.\u201d&nbsp; He states, \u201clocal abortion bans don\u2019t work. They clash with state law, they can\u2019t be enforced and they make pro-life advocacy look unserious.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Lane\u2019s claims show his ignorance of the pro-life movement\u2019s effectiveness.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In June 2019, Waskom, Texas, became the first city in the nation to&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/nation\/2019\/06\/13\/waksom-texas-outlaws-abortion-five-men\/\" target=\"_blank\" rel=\"noreferrer noopener\">adopt<\/a>&nbsp;an ordinance outlawing abortion. The measure was meant to prevent an abortion facility in Louisiana from relocating to Waskom. The ordinance led to the&nbsp;<a href=\"https:\/\/www.texastribune.org\/2021\/05\/01\/lubbock-abortion-vote-sanctuary-unborn\/\" target=\"_blank\" rel=\"noreferrer noopener\">passage<\/a>&nbsp;of Lubbock\u2019s ordinance in May 2021. Unlike Waskom, Lubbock had an abortion facility actively committing abortions. Before the ordinance went into effect, Planned Parenthood&nbsp;<a href=\"https:\/\/www.texastribune.org\/2021\/05\/17\/lubbock-abortion-ban-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued Lubbock.<\/a>&nbsp;Two weeks later, the ordinance went into effect, Planned Parenthood complied, and the abortion giant lost its case in federal district court. This was the first time in the history of legal abortion in America that a&nbsp;<a href=\"https:\/\/www.texastribune.org\/2021\/06\/01\/abortion-planned-parenthood-lubbock\/\" target=\"_blank\" rel=\"noreferrer noopener\">pre-viability abortion ban went into effect<\/a>&nbsp;that actually stopped abortions.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">When&nbsp;<em>Roe v. Wade<\/em>&nbsp;fell in 2022 and abortion facilities left Texas, Whole Woman\u2019s Health attempted to relocate just miles from the border in Hobbs, New Mexico. After Hobbs&nbsp;<a href=\"https:\/\/www.reuters.com\/world\/us\/new-mexico-city-passes-ordinance-block-abortion-clinics-operating-2022-11-08\/\" target=\"_blank\" rel=\"noreferrer noopener\">introduced its ordinance<\/a>&nbsp;in November 2022, the abortion giant abandoned its lease and fled five hours away to Albuquerque. In October 2023, Lubbock County&nbsp;<a href=\"https:\/\/www.nytimes.com\/2023\/10\/24\/us\/texas-abortion-travel-bans.html\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a>&nbsp;a county ordinance prohibiting abortion trafficking in unincorporated areas of the county. The Texas Observer&nbsp;<a href=\"https:\/\/www.texasobserver.org\/far-right-abortion-vote-amarillo\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, \u201cWhen news broke that Lubbock County would be considering an abortion travel ban, every patient from Dallas canceled their appointments at the Albuquerque clinic.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Lane says that both Danville and the national pro-life cause deserve better, but he fails to understand the role such local measures are playing in the overall effort to end abortion in America. Cities throughout Texas&nbsp;<a href=\"https:\/\/apnews.com\/article\/texas-us-supreme-court-laws-185e383ba4aa6cfc558231dcabd4104a\" target=\"_blank\" rel=\"noreferrer noopener\">paved the way<\/a>&nbsp;for the Texas Heartbeat Act, which historians argue played a significant role in overturning&nbsp;<em>Roe<\/em>. It was cities and counties throughout Southeastern New Mexico that helped&nbsp;<a href=\"https:\/\/www.yalelawjournal.org\/article\/comstockery\" target=\"_blank\" rel=\"noreferrer noopener\">inspire<\/a>&nbsp;Project 2025\u2019s strategy against abortion. Lane misses the bigger picture.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The goal of pro-life legislation is not to \u201cpersuade hearts and minds\u201d but to protect unborn children and their mothers from a predatory abortion industry. These ordinances are not \u201chollow gestures\u201d \u201cdestined to collapse in court,\u201d but real-world solutions that make an actual difference in the fight against abortion in America. It\u2019s not \u201cperformance\u201d or \u201ctheater.\u201d It\u2019s loving our unborn neighbor. It\u2019s keeping instruments of death meant to kill our smallest friends out of our communities. If that is not a \u201creal policy fight,\u201d what is? Filling potholes?<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Danville city leaders continue to stand firm with no regrets for their decision. Earlier this year, CNN&nbsp;<a href=\"https:\/\/www.cnn.com\/2025\/01\/22\/health\/abortion-clinics-local-influence\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>&nbsp;on the status of the Danville facility. Their report ended stating, \u201cthe Illinois clinic still hasn\u2019t opened.\u201d The facility has gained a reputation for claiming to be&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20250122125553\/https:\/www.acsdanville.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">open<\/a>&nbsp;when it has not been.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">While Lane states that the Danville Ordinance \u201cguarantees only costly litigation,\u201d there has been zero litigation in the two years and four months since the measure\u2019s&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/city-danville-first-sanctuary-unborn-illinois\" target=\"_blank\" rel=\"noreferrer noopener\">passage<\/a>.
