While voters approved\u00a0<a href=\"https:\/\/www.jezebel.com\/7-out-of-10-pro-choice-amendments-passed-trump-could-override-them-all\" target=\"_blank\" rel=\"noreferrer noopener\">seven out of 10<\/a>\u00a0pro-choice ballot measures, they also elected Donald Trump to a second term, which threatens abortion access nationwide. As we brace for federal restrictions, state lawmakers are moving to hamper future abortion ballot campaigns, and are even attacking amendments that have already passed.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Bills introduced across the country would make it harder to get proposals on the ballot, more difficult to pass them and would undermine newly adopted constitutional amendments. These actions directly contradict conservative refrains that the Supreme Court overturning&nbsp;<em>Roe v. Wade<\/em>&nbsp;would send the issue of abortion back to the states. It turns out that Republicans don\u2019t actually like it when voters have a direct say on abortion, because access to abortion is popular. They would prefer representative democracy, or the people electing lawmakers to gerrymandered districts to vote on issues for them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-here-are-some-of-the-most-recent-attacks-on-direct-democracy\"><strong>Here are some of the most recent attacks on direct democracy.<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">Idaho lawmakers are moving to&nbsp;<a href=\"https:\/\/idahocapitalsun.com\/briefs\/idaho-representative-introduces-bill-to-raise-voting-threshold-to-60-for-ballot-initiatives\/\" target=\"_blank\" rel=\"noreferrer noopener\">make it harder to amend<\/a>&nbsp;the state constitution with&nbsp;<a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2025\/legislation\/H0002\/\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 2<\/a>, which would raise the threshold for amendments to pass from a simple majority to 60%. It\u2019s no coincidence that a group called Idahoans United for Women and Families had already announced a campaign to&nbsp;<a href=\"https:\/\/idahocapitalsun.com\/2024\/08\/15\/idaho-group-files-four-initiative-proposals-to-restore-abortion-access-to-ban-state\/\" target=\"_blank\" rel=\"noreferrer noopener\">overturn<\/a>&nbsp;the state\u2019s devastating abortion ban via a measure on the November 2026 ballot. Idaho\u2019s ban lacks exceptions for threats to patient health and the Biden administration sued the state for violating a federal law regulating emergency room care.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">During the four months the law was in effect, doctors&nbsp;<a href=\"https:\/\/idahocapitalsun.com\/2024\/04\/23\/loss-of-federal-protection-in-idaho-spurs-pregnant-patients-to-plan-for-emergency-air-transport\/\" target=\"_blank\" rel=\"noreferrer noopener\">airlifted<\/a>&nbsp;six patients to neighboring states to get care, rather than risk prosecution. (The Trump administration is expected to drop the case, but a hospital system&nbsp;<a href=\"https:\/\/idahocapitalsun.com\/2025\/01\/15\/idahos-largest-health-system-sues-ag-seeking-emergency-abortion-protections\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a>&nbsp;the state itself last month to try to keep the law blocked.)<\/p>\n\n\n\n<p class=\"has-medium-font-size\">If H.B. 2 passes, it would make it much harder to restore abortion access in the state. Luke Mayville, co-founder of pro-ballot initiative group Reclaim Idaho,&nbsp;<a href=\"https:\/\/idahocapitalsun.com\/briefs\/idaho-representative-introduces-bill-to-raise-voting-threshold-to-60-for-ballot-initiatives\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;the Idaho Capital-Sun that lawmakers \u201care attempting to rig the process so that future initiatives will fail even when they are supported by the majority of voters.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It\u2019s a common strategy: South Dakota lawmakers are also trying to&nbsp;<a href=\"https:\/\/apnews.com\/us-news\/south-dakota-jim-leach-constitutions-democracy-tom-daschle-b61049f2540c1b8ea736e0b3b59304e3\" target=\"_blank\" rel=\"noreferrer noopener\">raise<\/a>&nbsp;the passage threshold for constitutional amendments from a simple majority up to 60%. Of the&nbsp;<a href=\"https:\/\/ballotpedia.org\/Initiated_constitutional_amendment\" target=\"_blank\" rel=\"noreferrer noopener\">18 states<\/a>&nbsp;that allow voters to initiate their own amendments, only two have a vote requirement that high: Florida and Illinois. The&nbsp;<a href=\"https:\/\/sdlegislature.gov\/Session\/Bill\/25663\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a>&nbsp;to increase the benchmark, House Joint Resolution 5003, could head to voters in 2026 and, curiously, only needs a simple majority to pass. It seems the drafters don\u2019t want to hold their own proposal to the standard it would enshrine.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">South Dakota politicians tried and failed to achieve this aim in 2018 and 2022. (Ohio lawmakers also tried this tactic in 2023 ahead of an abortion amendment and&nbsp;<a href=\"https:\/\/apnews.com\/article\/ohio-abortion-rights-constitutional-amendment-special-election-227cde039f8d51723612878525164f1a\" target=\"_blank\" rel=\"noreferrer noopener\">failed<\/a>, while the pro-choice measure later&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2023-elections\/ohio-ballot-measures\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a>&nbsp;with 57% support.) Another&nbsp;<a href=\"https:\/\/sdlegislature.gov\/Session\/Bill\/25841\" target=\"_blank\" rel=\"noreferrer noopener\">proposal<\/a>&nbsp;would increase the number of signatures required for amendments to make the South Dakota ballot from 10% of the general electorate to 15%.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Rick Weiland, who sponsored last year\u2019s&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-elections\/ballot-measures\" target=\"_blank\" rel=\"noreferrer noopener\">unsuccessful<\/a>&nbsp;abortion amendment,&nbsp;<a href=\"https:\/\/apnews.com\/us-news\/south-dakota-jim-leach-constitutions-democracy-tom-daschle-b61049f2540c1b8ea736e0b3b59304e3\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;the Associated Press, \u201cthey\u2019re attempting to orchestrate the death of direct democracy by a thousand cuts.\u201d That amendment, which&nbsp;<a href=\"https:\/\/19thnews.org\/2024\/11\/south-dakota-abortion-ballot-measure-results\/\" target=\"_blank\" rel=\"noreferrer noopener\">did not<\/a>&nbsp;have&nbsp;<a href=\"https:\/\/southdakotasearchlight.com\/2023\/12\/06\/abortion-rights-groups-dont-support-ballot-measure-that-aims-to-restore-abortion-access\/\" target=\"_blank\" rel=\"noreferrer noopener\">support<\/a>&nbsp;from groups like Planned Parenthood or the ACLU, failed by a vote of 41% to 59%. But a women-led group is in the&nbsp;<a href=\"https:\/\/southdakotasearchlight.com\/2025\/02\/09\/sd-democratic-lawmakers-forgo-abortion-exception-legislation-as-ballot-measure-brews\/\" target=\"_blank\" rel=\"noreferrer noopener\">early stages<\/a>&nbsp;of&nbsp;<a href=\"https:\/\/x.com\/Ajzionts\/status\/1875279823771463793\" target=\"_blank\" rel=\"noreferrer noopener\">preparing<\/a>&nbsp;a campaign for 2026.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Florida is another state where a 2024 abortion ballot measure failed. Amendment 4 received a majority of the vote with&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-elections\/florida-ballot-measures\" target=\"_blank\" rel=\"noreferrer noopener\">57%<\/a>, but did not pass because of a 60% floor&nbsp;<a href=\"https:\/\/www.wtsp.com\/article\/news\/politics\/elections\/voting\/florida-amendment-results-need-60-percent-abortion-marijuana\/67-c60d3ab6-1455-4985-b50a-3d8a545905b0\" target=\"_blank\" rel=\"noreferrer noopener\">enshrined<\/a>&nbsp;in 2006. The state bans abortions after embryonic cardiac activity, or about six weeks of pregnancy, and it seems Gov. Ron DeSantis (R) doesn\u2019t want voters to have another chance to overturn the law. DeSantis&nbsp;<a href=\"https:\/\/www.flgov.com\/eog\/legislative-special-session-proposals\" target=\"_blank\" rel=\"noreferrer noopener\">proposed<\/a>&nbsp;changes he wants the legislature to pass that would<a href=\"https:\/\/www.miamiherald.com\/opinion\/editorials\/article298986130.html\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;effectively end citizen-led amendments<\/a>&nbsp;by requiring people to&nbsp;<a href=\"https:\/\/www.tampabay.com\/news\/florida-politics\/2025\/01\/21\/desantis-florida-petition-amendment-ballot-initiative-change-signature\/\" target=\"_blank\" rel=\"noreferrer noopener\">go to an elections office<\/a>&nbsp;to sign a petition or request one by mail. That would mean no more clipboard-wielding people collecting signatures on sidewalks.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"821\" height=\"149\" src=\"https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2025\/04\/Roe-Statement.jpg\" alt=\"\" class=\"wp-image-33918\" srcset=\"https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2025\/04\/Roe-Statement.jpg 821w, https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2025\/04\/Roe-Statement-300x54.jpg 300w, https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2025\/04\/Roe-Statement-768x139.jpg 768w\" sizes=\"auto, (max-width: 821px) 100vw, 821px\" \/><\/figure><\/div>\n\n\n<p class=\"has-medium-font-size\">For petitions that do somehow manage to get enough signatures, DeSantis\u2019 proposal would even&nbsp;<a href=\"https:\/\/www.flgov.com\/eog\/legislative-special-session-proposals\" target=\"_blank\" rel=\"noreferrer noopener\">require<\/a>&nbsp;the Florida Supreme Court to determine whether they comply with the \u201c<a href=\"https:\/\/www.flsenate.gov\/laws\/constitution#A1S02\" target=\"_blank\" rel=\"noreferrer noopener\">inalienable rights<\/a>\u201d section of the state constitution, which grants rights to life, liberty and happiness. When the court\u2019s seven justices considered Amendment 4 last year, it only got approved&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2024\/04\/florida-november-abortion-vote-desantis.html\" target=\"_blank\" rel=\"noreferrer noopener\">by one vote<\/a>. Three of them said the measure should not appear on the ballot because it didn\u2019t inform voters that it&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2024\/04\/florida-november-abortion-vote-desantis.html\" target=\"_blank\" rel=\"noreferrer noopener\">could undermine<\/a>&nbsp;the rights of fetuses \u201cto enjoy and defend life\u201d under the state constitution.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Michelle Morton, a staff attorney at the ACLU of Florida,&nbsp;<a href=\"https:\/\/www.tampabay.com\/news\/florida-politics\/2025\/01\/21\/desantis-florida-petition-amendment-ballot-initiative-change-signature\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;the&nbsp;<em>Tampa Bay Times<\/em>&nbsp;that this provision in particular feels targeted at abortion amendments. \u201cIt\u2019s unfortunate that when the governor saw that so many people want to repeal these bans, this is the reaction,\u201d Morton said. Lawmakers did not act on DeSantis\u2019 proposal in a recent special session, but they could consider it during the regular session that begins in March.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In Arkansas, lawmakers want to throw sand in the gears of signature collection.&nbsp;<a href=\"https:\/\/arkleg.state.ar.us\/Bills\/Detail?id=sb210&amp;ddBienniumSession=2025%2F2025R&amp;Search=\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Bill 210<\/a>&nbsp;would require canvassers to read the ballot title to every person interested in signing the petition, while&nbsp;<a href=\"https:\/\/arkleg.state.ar.us\/Bills\/Detail?id=sb208&amp;ddBienniumSession=2025%2F2025R&amp;Search=\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Bill 208<\/a>&nbsp;would require them to ask to see photo ID before a person can sign. If the voter cannot produce ID, they cannot sign. In August 2024, the state Supreme Court rejected an abortion amendment due to a&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-ballot-arkansas-supreme-court-48c208d49d82b467fbcc4b9c2724617a\" target=\"_blank\" rel=\"noreferrer noopener\">paperwork error<\/a>&nbsp;for signatures collected by paid canvassers; the campaign fell about 3,000 signatures short.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Even more galling than attacking future ballot measures, some lawmakers are trying to undermine amendments that voters&nbsp;<em>already<\/em>&nbsp;approved.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Arizonans passed a ballot measure guaranteeing the right to abortion until fetal viability with&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-elections\/ballot-measures\" target=\"_blank\" rel=\"noreferrer noopener\">62%<\/a>&nbsp;of the vote in November. Earlier this month, one Arizona lawmaker filed&nbsp;<a href=\"https:\/\/apps.azleg.gov\/BillStatus\/BillOverview\/83369?SessionId=129\" target=\"_blank\" rel=\"noreferrer noopener\">House Concurrent Resolution 2058<\/a>, a proposal for a&nbsp;<a href=\"https:\/\/azcapitoltimes.com\/news\/2025\/02\/11\/lawmaker-introduces-legislation-to-counter-winning-abortion-ballot-measure\/\" target=\"_blank\" rel=\"noreferrer noopener\">new ballot measure<\/a>&nbsp;that, if passed, would allow state lawmakers to preserve \u201cprenatal life at all stages of development,\u201d meaning they could enact bans. This is an attempt to overturn Proposition 139, which sponsor state Rep. Rachel Keshel (R) claimed was warranted. \u201cI think voters were misled on Prop 139,\u201d she&nbsp;<a href=\"https:\/\/azcapitoltimes.com\/news\/2025\/02\/11\/lawmaker-introduces-legislation-to-counter-winning-abortion-ballot-measure\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;Capitol Media Services. \u201cThere were a lot of untruths about it.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But no state can top the brazen efforts by Missouri Republicans to undermine Amendment 3, which passed with nearly 52% support to overturn the state\u2019s abortion ban. Lawmakers introduced a fetal personhood&nbsp;<a href=\"https:\/\/house.mo.gov\/bill.aspx?bill=HB1072&amp;year=2025&amp;code=R\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a>&nbsp;called the \u201cMissouri Prenatal Equal Protection Act\u201d that defines life as beginning at fertilization. This would ban all abortions in contravention to Amendment 3, which established a right to abortion until fetal viability.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Another proposal,&nbsp;<a href=\"https:\/\/house.mo.gov\/bill.aspx?bill=HB194&amp;year=2025&amp;code=R\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 194<\/a>, would ban abortion after cardiac activity, again defying the constitutional amendment. But its sponsor, state Rep. Brian Seitz (R),&nbsp;<a href=\"https:\/\/missouriindependent.com\/2024\/12\/20\/missouri-republicans-restrict-abortion-amendment-3\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;reporters that the bill is about defining viability as starting after the \u201cheartbeat\u201d can be detected \u2014 except that\u2019s&nbsp;<a href=\"https:\/\/www.thecut.com\/2019\/05\/embryos-dont-have-hearts.html\" target=\"_blank\" rel=\"noreferrer noopener\">before<\/a>&nbsp;the heart is even formed.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Another tactic is to send a second ballot measure to voters, but this time it would&nbsp;<a href=\"https:\/\/missouriindependent.com\/2025\/02\/05\/missouri-abortion-ban-constitutional-amendment-stinnett-rape-incest-exception\/\" target=\"_blank\" rel=\"noreferrer noopener\">ban<\/a>&nbsp;both abortion and youth gender-affirming care, which doesn\u2019t have as much popular support.&nbsp;<a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HJR54&amp;year=2025&amp;code=R\" target=\"_blank\" rel=\"noreferrer noopener\">House Joint Resolution 54<\/a>&nbsp;is a cynical attempt to get voters to allow abortion restrictions, wrapped in the guise of choice. \u201cThis is not politicians making decisions for you, your doctor and your healthcare,\u201d state Rep. Jamie Gragg (R)&nbsp;<a href=\"https:\/\/fox2now.com\/news\/missouri\/gop-representatives-want-to-ask-missouri-voters-again-about-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;Fox2 St. Louis. \u201cThis is actually letting you guys make that decision again.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">And, after a judge blocked restrictions that paved the way for&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-missouri-12de739e55ae7af8f6cc9b2348c1ad54\" target=\"_blank\" rel=\"noreferrer noopener\">abortions to resume<\/a>, one Republican lawmaker really gave the game away. \u201cI\u2019m here to tell you the Missouri supermajority of Republicans will not stand for this,\u201d&nbsp;<a href=\"https:\/\/missouriindependent.com\/2025\/02\/17\/republicans-vow-action-after-judges-ruling-allows-abortion-to-resume-in-missouri\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;state Sen. Mary Elizabeth Coleman. \u201cThere will be another option to vote, so that people understand this is not going to continue in the state of Missouri.\u201d The people of Missouri voted for abortion access to be restored, but here is Coleman saying she will wield GOP power in the statehouse to try to undo that result.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Overturning&nbsp;<em>Roe<\/em>&nbsp;was never just about sending abortion back to the states. It was a necessary step on the path to allowing pre-existing state bans to take effect, and to banning abortion nationwide. Republicans keep showing us that their claims about giving voters agency to determine laws where they live were lies.<\/p>\n\n\n\n<p style=\"font-size:18px\"><em><strong>Susan Rinkunas is an independent journalist covering abortion, reproductive health, and politics.
