Ohio\u00a0Senate Bill 23<\/a>\u00a0was designed to protect unborn babies from abortion after six-weeks and passed in 2019. In 2023, a constitutional amendment was passed by 57% of the voters in Ohio that made abortion a \u201cfundamental right\u201d in the state\u2019s constitution. The contradiction in the two policies resulted in a multi-year, back-and-forth battle about the five-year-old \u201cheartbeat\u201d law \u2014 until state Judge Christian Jenkins of the Hamilton County Court of Common Pleas permanently blocked the protections last week.<\/p>\n\n\n\n

\u201cOhio voters have spoken,\u201d the judge\u00a0wrote<\/a>. \u201cThe Ohio Constitution now unequivocally protects the right to abortion.\u201d In addition to stripping the state of its six-week pro-life protections, the 2023 amendment also blocks other pro-life provisions such as ensuring a doctor checks the heartbeat of a baby before carrying out an abortion, informing the parents of viability, and having patients wait 24 hours after a doctor\u2019s visit before moving forward with an abortion. \u201cThese are commonsense type measures,\u201d said former congressman and guest host Jody Hice on Friday\u2019s episode of \u201cWashington Watch<\/a>.\u201d However, \u201cnow they cannot be applied \u2026 because a judge has determined all of these are unconstitutional in the state of Ohio.\u201d<\/p>\n\n\n\n

Jenkins\u2019s ruling comes as\u00a010 states have abortion-related initiatives<\/a>\u00a0on their November ballots. Considering this, Hice asked, \u201cWhat kind of warning should be sent to those states as a result of what has happened now in Ohio?\u201d According to the President of the Center for Christian Virtue (CCV) Aaron Baer, it\u2019s important to understand that \u201cthis decision made by this judge is going to cost tens of thousands of lives in Ohio.\u201d<\/p>\n\n\n\n

He continued, \u201c[I]t\u2019s just heartbreaking. \u2026 [A]t the end of the day, all of us in the pro-life movement are involved in this fight because we care about the little ones that God has knit together in the womb.\u201d But last week\u2019s decision is \u201calso frustrating,\u201d Baer acknowledged, \u201cbecause we spent last year fighting to educate voters about the true radical nature of a constitutional amendment that was proposed, and we were fighting millions of dollars from foreign backed entities and the media and all of their disinformation about the implications of this abortion amendment.\u201d<\/p>\n\n\n\n

Ohio\u2019s constitutional amendment also put other \u201ccommonsense health and safety regulations\u201d at risk,\u201d Baer emphasized, such as \u201crequirements that say that only doctors are allowed to do abortions\u201d as well as the potential \u201cstripping away [of] protections on chemical abortions.\u201d Hice explained that the \u201cpotential domino effect\u201d caused by enshrining abortion into a state constitution should be a \u201cwarning\u201d to the states that have abortion on their November ballots. \u201cAbsolutely,\u201d Baer agreed.<\/p>\n\n\n\n

As part of that warning, Baer said his hope is that the \u201cugly and devastating truth of what\u2019s actually happening in Ohio because of this abortion amendment can give those pro-lifers [in the states with abortion ballot initiatives] a little bit more ammunition to get the truth out there.\u201d For pro-lifers in Ohio, Baer urged, it\u2019s crucial to keep \u201ctelling the true story of this abortion amendment\u201d so that voters will hopefully \u201csee that they\u2019ve gone down a dangerous and deadly path and that we need to pull back.\u201d But this advice, he added, applies to all pro-lifers in states with abortion-related ballot initiatives.<\/p>\n\n\n\n

\u201cFocus on \u2026 the truth of these abortion amendments,\u201d he emphasized. Help people understand \u201cthe really radical nature of what they do\u201d and \u201ccontinue to stand on principle about the value of every unborn life \u2014 the sanctity, the dignity, the beauty of children. That message is so important. We need to continue to carry it no matter what happens with these abortion amendments.\u201d Additionally, pro-lifers need to pay attention to how \u201cthe Left tr[ies] to use the abortion issue to attack candidates\u201d by getting \u201cthem to back off of their stance for their pro-life views.\u201d<\/p>\n\n\n\n

Baer also addressed how political leaders \u201cneed to hold fast to what you know is true.\u201d And for all \u201cpro-life activists out there, you need to continue to get out there and expose\u201d the reality of the pro-abortion side, \u201cbecause you can win these things.\u201d<\/p>\n\n\n\n

\u201cLife is a winning message,\u201d Hice concluded. \u201cPeople just have to understand it.\u201d<\/p>\n\n\n\n
