It would prohibit the state from restricting abortion before fetal viability or when a healthcare professional considers an abortion \u201cnecessary to protect the life or physical or mental health of the pregnant individual.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>Pro-life groups behind the It Goes Too Far campaign\u00a0<a href=\"https:\/\/www.itgoestoofar.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">are urging voters<\/a>\u00a0to consider that \u201cthe law in Arizona has been settled. Abortion is legal up to 15 weeks and beyond that for medical emergencies,\u201d according to the campaign\u2019s website. The amendment, it says, would wipe out \u201ccommonsense safety precautions\u201d and legalize abortion for essentially any reason after viability because of the broad mental health exception.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The polling:\u00a0<\/strong>An August poll by SSRS for CNN found that the amendment had support from\u00a0<a href=\"https:\/\/s3.documentcloud.org\/documents\/25088820\/cnn-polls-across-six-battlegrounds-find-georgia-and-pennsylvania-are-key-toss-ups.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">62<\/a>\u00a0percent of voters, while a Fox News poll, also in August, found support from\u00a0<a href=\"https:\/\/static.foxnews.com\/foxnews.com\/content\/uploads\/2024\/08\/Fox_August-23-26-2024_Arizona_Cross-Tabs_August-28-Release.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">73 percent<\/a>\u00a0of voters. The amendment needs a simple majority to pass.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Colorado Amendment 79: Constitutional Right to Abortion<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:&nbsp;<\/strong>Colorado law grants pregnant women a fundamental right to have an abortion while explicitly denying rights to unborn babies. The state does not protect unborn life under any circumstances.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>The amendment from Coloradans for Protecting Reproductive Freedom\u00a0<a href=\"https:\/\/www.sos.state.co.us\/pubs\/elections\/Initiatives\/titleBoard\/filings\/2023-2024\/89Final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">would put similar language<\/a>\u00a0directly in the state constitution. Its explicit acknowledgment of a \u201cright to abortion\u201d would prohibit the government from denying, impeding, or discriminating against \u201cthe exercise of that right\u201d in future laws. It would also strike from the constitution a section that prohibits the use of taxpayer dollars to fund abortions.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>Colorado Right to Life has sued the state of Colorado over its\u00a0<a href=\"https:\/\/leg.colorado.gov\/sites\/default\/files\/bluebook_english_2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">2024 ballot information booklet<\/a>, which claims that the measure will \u201chave no fiscal impact to state and local governments.\u201d Executive director Scott Shamblin\u00a0<a href=\"https:\/\/gazette.com\/denver-gazette\/guest-column-state-is-deceiving-voters-about-amendment-79\/article_1f832434-71d4-11ef-b137-97d87a2bd56e.html\" target=\"_blank\" rel=\"noreferrer noopener\">said in a guest column<\/a>\u00a0for\u00a0<em>The Gazette<\/em>\u00a0that the booklet\u2019s claim is false, given that the amendment \u201cwould repeal the current ban on using taxpayer money to fund abortions and open the door for Medicaid and public employee health plans to cover abortion services.\u201d He adds that the language would prevent lawmakers from passing legislation \u201cto protect pre-born babies and their mothers.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The polling:\u00a0<\/strong>According to\u00a0<em>Colorado Politics<\/em>,\u00a0<a href=\"https:\/\/www.coloradopolitics.com\/elections\/2024\/colorado-amendment-79-abortion-rights\/article_e7931948-7062-11ef-8703-3bf964d68882.html\" target=\"_blank\" rel=\"noreferrer noopener\">supporters of the amendment found<\/a>\u00a0that 60 to 70 percent of survey respondents backed the measure last year. It\u00a0<a href=\"https:\/\/leg.colorado.gov\/sites\/default\/files\/images\/2023-2024_89vbb.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">needs 55 percent<\/a>\u00a0of the vote to pass.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Maryland Question 1: Right to Reproductive Freedom Amendment<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:\u00a0<\/strong>Maryland\u00a0<a href=\"https:\/\/elections.maryland.gov\/elections\/1992\/results_1992\/ballot_questions.html\" target=\"_blank\" rel=\"noreferrer noopener\">voters in 1992 approved<\/a>\u00a0a statute prohibiting the state from interfering with an abortion decision before the point in pregnancy when a baby can live outside the womb. Abortion is\u00a0<a href=\"https:\/\/casetext.com\/statute\/code-of-maryland\/article-health-general\/title-20-miscellaneous-health-provisions\/subtitle-2-abortions-artificial-insemination-sterilizations\/part-ii-abortion-procedures\/section-20-209-intervention-regulations-liability\" target=\"_blank\" rel=\"noreferrer noopener\">legal in Maryland<\/a>\u00a0for any reason before viability and after that when necessary to protect a woman\u2019s life or health or if the baby has a genetic defect.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>The amendment\u2014initiated by the legislature in 2023\u2014<a href=\"https:\/\/mgaleg.maryland.gov\/2023RS\/bills\/sb\/sb0798T.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">would add<\/a>\u00a0to the constitution\u2019s declaration of rights the assertion that \u201cevery person \u2026 has the fundamental right to reproductive freedom\u201d including ending a pregnancy. It would prohibit the state from denying, burdening, or abridging that right \u201cunless justified by a compelling state interest achieved by the least restrictive means.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>The group Health Not Harm MD\u00a0<a href=\"https:\/\/www.healthnotharmmd.org\/letter-to-voters\" target=\"_blank\" rel=\"noreferrer noopener\">points out on its website<\/a>\u00a0that \u201cabortion rights \u2026 are already fully protected under state law.\u201d It says the amendment targets children for sterilization and medical attempts to change their sex characteristics. The group also says the measure would make abortion unsafe in the state by preventing the legislature from passing laws to safeguard women.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The polling:\u00a0<\/strong>A 2022 Washington Post-University of Maryland poll\u00a0<a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2023\/03\/30\/maryland-abortion-vote-referendum\/\" target=\"_blank\" rel=\"noreferrer noopener\">found that<\/a>\u00a078 percent of voters supported a pro-abortion constitutional amendment. It\u00a0<a href=\"https:\/\/msa.maryland.gov\/msa\/mdmanual\/43const\/html\/14art14.html\" target=\"_blank\" rel=\"noreferrer noopener\">needs support<\/a>\u00a0from a majority of voters in order to pass.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>New York Proposal 1: Amendment to Protect Against Unequal Treatment<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:\u00a0<\/strong>New York law\u00a0<a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PBH\/2599-AA\" target=\"_blank\" rel=\"noreferrer noopener\">already recognizes<\/a>\u00a0a \u201cfundamental right \u2026 to have an abortion\u201d and\u00a0<a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PBH\/2599-BB\" target=\"_blank\" rel=\"noreferrer noopener\">allows abortion<\/a>\u00a0for any reason until 24 weeks of pregnancy and after if the baby isn\u2019t viable or the abortion is deemed necessary to protect the mother\u2019s life and health.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>The ballot measure\u2014approved by the legislature in the 2022 and 2023 legislative sessions\u2014<a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2023\/A1283\" target=\"_blank\" rel=\"noreferrer noopener\">would add text<\/a>\u00a0to an existing article in the state constitution that already prohibits discrimination on the basis of race, color, creed, or religion. The additional language would amend the constitution to list \u201csexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy\u201d and additional categories as protected under the constitution.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>The Coalition to Protect Kids-NY\u00a0<a href=\"https:\/\/www.protectkidsny.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">has nicknamed the amendment<\/a>\u00a0\u201cthe Parent Replacement Act.\u201d It warns that the proposal would allow gender-confused children to undergo surgery to change their sex traits without approval from their parents. It also could require schools to allow boys to play on girls\u2019 sports teams. The coalition says the inclusion of abortion-related language is a distraction from the real issues of parental rights, given that New York law already \u201cprovides robust protections for abortion.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The polling:\u00a0<\/strong>An August poll from Siena College Research Institute\u00a0<a href=\"https:\/\/scri.siena.edu\/2024\/08\/06\/harris-leads-trump-by-14-points-53-39-up-from-bidens-8-point-lead-in-june-in-6-way-matchup-harris-leads-by-12-points-rfk-7\/\" target=\"_blank\" rel=\"noreferrer noopener\">found that<\/a>\u00a068 percent of surveyed voters support the amendment. It requires a simple majority to pass.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Nevada Question 6: Reproductive Rights Amendment<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:\u00a0<\/strong>Nevada voters in 1990\u00a0<a href=\"https:\/\/www.leg.state.nv.us\/Division\/Research\/VoteNV\/BallotQuestions\/1990.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">approved a state statute<\/a>\u00a0allowing licensed physicians to perform abortions in the first 24 weeks of pregnancy with broad health exceptions later in pregnancy.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>This year\u2019s ballot measure from Nevadans for Reproductive Freedom\u00a0<a href=\"https:\/\/www.nvsos.gov\/sos\/home\/showpublisheddocument\/12633\/638375592027970000\" target=\"_blank\" rel=\"noreferrer noopener\">would add to the state constitution<\/a>\u00a0\u201ca fundamental right to abortion\u201d until fetal viability or afterwards to protect the life or health of the \u201cpregnant patient.\u201d It expands the performance of abortions from licensed physicians to any \u201cqualified healthcare practitioner.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>Nevada Right to Life\u00a0<a href=\"https:\/\/nevadaamendmenttruth.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">warns that the amendment<\/a>\u00a0is too vague and will result in judges deciding all abortion laws, keeping Nevadans out of the legislative process. The group says the amendment\u2019s broad definition of fetal viability leaves the line for legal abortion up to the discretion of abortionists. It would also prevent a parental notification requirement long held up in courts from ever taking effect, allowing minors to get abortions without their parents knowing.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The polling:\u00a0<\/strong>An August poll\u00a0<a href=\"https:\/\/static.foxnews.com\/foxnews.com\/content\/uploads\/2024\/08\/Fox_August-23-26-2024_Nevada_Cross-Tabs_August-28-Release.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">found that<\/a>\u00a075 percent of survey respondents would vote yes on the amendment while only 21 percent would vote against it. A majority of voters\u00a0<a href=\"https:\/\/www.nvsos.gov\/sos\/elections\/initiatives-referenda\/filing-a-constitutional-initiative\" target=\"_blank\" rel=\"noreferrer noopener\">will have to approve<\/a>\u00a0the amendment in two consecutive elections in order for it to pass.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Red states<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Florida Amendment 4:<\/strong>&nbsp;<strong>Amendment to Limit Government Interference with Abortion<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:\u00a0<\/strong><a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/0390.0111\" target=\"_blank\" rel=\"noreferrer noopener\">Current law<\/a>\u00a0in Florida allows for abortions until six weeks of pregnancy. It makes exceptions after that up to 15 weeks for cases of rape, incest, or human trafficking and through the second trimester if the baby has a \u201cfatal fetal abnormality.\u201d Abortion is legal throughout pregnancy to protect the mother\u2019s life or physical health.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>The amendment from Floridians Protecting Freedom\u00a0<a href=\"https:\/\/initiativepetitions.elections.myflorida.com\/InitiativeForms\/Fulltext\/Fulltext_2307_EN.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">would add<\/a>\u00a0a section to the state constitution stating that \u201cno law shall prohibit, penalize, delay, or restrict abortion before viability,\u201d unless \u201cnecessary to protect the patient\u2019s health.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>Florida Voters Against Extremism\u00a0<a href=\"https:\/\/votenoon4florida.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">warns on its website<\/a>\u00a0that the amendment keeps key terms undefined, including \u201cviability\u201d and \u201cpatient\u2019s health,\u201d leaving \u201cloopholes resulting in more abortions later in pregnancy than voters intend.\u201d The group also says that the amendment would overturn existing requirements that minors obtain permission from their parents before undergoing an abortion.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The polling:\u00a0<\/strong>A September poll from Emerson College Polling\/The Hill found that\u00a0<a href=\"https:\/\/emersoncollegepolling.com\/september-state-polling-california-florida-ohio-texas\/\" target=\"_blank\" rel=\"noreferrer noopener\">55 percent<\/a>\u00a0of voters would vote yes on the measure. A Mainstreet Research Survey poll in August found that the measure had\u00a0<a href=\"https:\/\/www.faupolling.com\/wp-content\/uploads\/2024\/08\/Mainstreet_FL_August_2024_Public.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">56<\/a>\u00a0percent support, while a poll commissioned by the Clean and Prosperous America political action committee found that\u00a0<a href=\"https:\/\/cleanprosperousamerica.org\/wp-content\/uploads\/CaPA-FL-TX-Polls-Aug-2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">61 percent<\/a>\u00a0of voters would approve. The amendment requires a 60 percent supermajority to pass.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Missouri Amendment 3: The Right to Reproductive Freedom Initiative<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:\u00a0<\/strong>Missouri\u00a0<a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=188.017\" target=\"_blank\" rel=\"noreferrer noopener\">protects<\/a>\u00a0unborn babies from abortion starting at conception with exceptions for medical emergencies.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>The amendment from Missourians for Constitutional Freedom\u00a0<a href=\"https:\/\/www.sos.mo.gov\/cmsimages\/Elections\/Petitions\/2024-086.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">would add a section<\/a>\u00a0to the Missouri Constitution saying that the government shall not \u201cdeny or infringe upon a person\u2019s fundamental right to reproductive freedom,\u201d which it defines as including prenatal care, childbirth, abortion, and other pregnancy-related matters. It allows the General Assembly to enact laws regulating abortion after viability as long as it makes exceptions for the life or physical or mental health of the mother.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>The group Missouri Stands with Women\u00a0<a href=\"https:\/\/mostandswithwomen.org\/wp-content\/uploads\/2024\/03\/DeclineToSignFlyer.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">distributed a \u201cdecline to sign\u201d flyer<\/a>\u00a0during the signature gathering phase. It urged voters not to sign any petition \u201cthat lets lobbying groups and the government take away your rights and freedom\u201d by \u201cinject[ing] abortion politics where it doesn\u2019t belong and where it isn\u2019t wanted.\u201d The flyer says the amendment could legalize abortion as a method of birth control.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The polling:\u00a0<\/strong>An August Saint Louis University\/YouGov poll\u00a0<a href=\"https:\/\/www.slu.edu\/research\/research-institute\/big-ideas\/slu-poll\/-pdf\/slu-poll-august-2024-topline-results.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">found that<\/a>\u00a052 percent of voters surveyed said they would support the amendment while 34 said they would not. The amendment requires a simple majority to pass.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Montana CI-128: Right to Abortion Initiative<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:\u00a0<\/strong><a href=\"https:\/\/www.leg.mt.gov\/bills\/mca\/title_0500\/chapter_0200\/part_0010\/section_0090\/0500-0200-0010-0090.html\" target=\"_blank\" rel=\"noreferrer noopener\">Current law<\/a>\u00a0in Montana allows abortion until fetal viability and afterward to preserve the life of the mother.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>The amendment from Montanans Securing Reproductive Rights\u00a0<a href=\"https:\/\/sosmt.gov\/wp-admin\/admin-ajax.php?juwpfisadmin=false&amp;action=wpfd&amp;task=file.download&amp;wpfd_category_id=26&amp;wpfd_file_id=63616&amp;token=33052d3e15a233cc3730046defc8f9a9&amp;preview=1\" target=\"_blank\" rel=\"noreferrer noopener\">would add<\/a>\u00a0a \u201cright to make and carry out decisions about one\u2019s own pregnancy, including a right to abortion\u201d to the state constitution. It would prohibit the government from interfering with that right except for after fetal viability as long as any law allows abortion to protect the life or health of the pregnant patient.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The opposition:\u00a0<\/strong>The Montana Life Defense Fund\u00a0<a href=\"https:\/\/www.montanafamily.org\/call_to_action\/\" target=\"_blank\" rel=\"noreferrer noopener\">says the amendment<\/a>\u00a0would eliminate parental consent requirements and allow any healthcare professional to decide if an abortion is necessary to protect the patient\u2019s health. The group adds that the language would allow for abortions throughout pregnancy, including partial birth abortions.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Nebraska Initiative 439: Protect the Right to Abortion Constitutional Initiative<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The law:\u00a0<\/strong>Nebraska\u00a0<a href=\"https:\/\/nebraskalegislature.gov\/FloorDocs\/108\/PDF\/Final\/LB574.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">protects<\/a>\u00a0unborn babies from abortion after 12 weeks of pregnancy except in cases of sexual assault, incest, or medical emergency.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The language:\u00a0<\/strong>The amendment from the Protect Our Rights campaign\u00a0<a href=\"https:\/\/sos.nebraska.gov\/sites\/sos.nebraska.gov\/files\/doc\/elections\/Petitions\/2024\/Protect%20the%20Right%20to%20Abortion%20Constitutional%20Amendment.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">would add<\/a>\u00a0\u201ca fundamental right to abortion until fetal viability\u201d to the state constitution, also establishing a right to abortion when needed to protect the mother\u2019s life or health.
