Multiple times, misinformation was shared regarding the current state of abortion laws in the United States \u2014 including abortion in cases of medical emergencies and cases of infanticide. Aside from the usual false rhetoric about \u201cTrump\u2019s abortion bans\u201d (which are both\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/fact-check-trump-nationwide-abortion-ban\/\" target=\"_blank\" rel=\"noreferrer noopener\">figments of the imagination and propaganda<\/a>), here are four lies told regarding abortion during the debate:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>LIE #1: Abortions don\u2019t happen in the ninth month of pregnancy.<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\"><em><strong>Truth: Abortion is legal for any reason up to birth in nine states and DC.<\/strong><\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size\">After being asked to discuss his position on abortion, Trump claimed that pro-abortion politicians want abortion to be legal \u201cin the ninth month.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Harris responded to that comment, saying, \u201cI absolutely support reinstating the protections of Roe v. Wade, and as you [pointing to moderator and&nbsp;<a href=\"https:\/\/x.com\/adamcarolla\/status\/1834082360369029174\" target=\"_blank\" rel=\"noreferrer noopener\">sorority sister<\/a>&nbsp;Linsey Davis] rightly mentioned, nowhere in America is a woman carrying a pregnancy to term and asking for an abortion. That is not happening; it\u2019s insulting to the women of America.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But this is&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/abortion-birth-thing-legal-9-states-dc\/\" target=\"_blank\" rel=\"noreferrer noopener\">inaccurate<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><em><strong>Abortion is legal through nine months of pregnancy for any reason in&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/abortion-birth-thing-legal-9-states-dc\/\" target=\"_blank\" rel=\"noreferrer noopener\">nine states plus Washington, D.C.<\/a>&nbsp;<\/strong><\/em>Those states are Alaska, Vermont, Oregon, New Mexico, Colorado, Minnesota, Michigan, Maryland, and New Jersey. Even more states than this will allow abortions up to birth for certain other reasons, such as to preserve the life or the very broad \u201chealth\u201d of the mother. And women are having abortions late in pregnancy for a&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/top-myths-debunked-late-term-abortions\/\" target=\"_blank\" rel=\"noreferrer noopener\">multitude of reasons<\/a>&nbsp;that are&nbsp;<em>not<\/em>&nbsp;related to their health.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">As writer Sarah Terzo&nbsp;<a href=\"https:\/\/sarahterzo.substack.com\/p\/woman-comes-to-abortion-clinic-nine\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>&nbsp;just hours before the debate, an example of this exact situation was shared in the book, \u201cWhy I am an Abortion Doctor,\u201d written by abortionist Suzanne Poppema, who was a board member of the National Abortion Federation at the time. Poppema wrote about a woman who came to her abortion business in&nbsp;<em>active labor<\/em>&nbsp;with a&nbsp;<em>full-term baby<\/em>. She wrote:<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><em>The staff woman told me that there was \u2018something weird\u2019 in the woman\u2019s vagina and that should couldn\u2019t find the cervix. This poor woman was writhing on the examination table with fluid here and there, dripping all over the place. The diagnosis was obvious.<\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size\">The woman was nine months pregnant and in labor and the \u201csomething weird\u201d was the baby\u2019s head, which the medical professional at the abortion facility was too undereducated to realize.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Poppema told the woman she was in labor, and the woman replied, \u201cBut I can\u2019t have a baby. I won\u2019t have a baby.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">This isn\u2019t the only case of a woman going in for an abortion late in pregnancy. Thousands of children are aborted after 21 weeks \u2014 so far, the youngest surviving age of a premature baby \u2014&nbsp;every year. Using data compiled by both&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/guttmacher-millions-planned-parenthood-funding-hidden\/\" target=\"_blank\" rel=\"noreferrer noopener\">the Guttmacher Institute<\/a>&nbsp;and the Centers for Disease Control and Prevention (CDC), Live Action research fellow Carole Novielli&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/abortion-data-2800-daily\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>&nbsp;that abortions committed&nbsp;<em>after 21 weeks<\/em>&nbsp;are estimated to have been committed on&nbsp;10,370&nbsp;preborn babies in 2023. That\u2019s a national death toll of 28 preborn babies older than 21 weeks&nbsp;<em>every single day<\/em>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Read more&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/abortion-birth-thing-legal-9-states-dc\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>LIE #2: There is no state in which \u2018abortion after birth\u2019 is legal.<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\"><em><strong>Truth: \u2018After birth abortion\u2019 does occur, and three states have loopholes that allow it.<\/strong><\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size\">At one point, debate moderator Davis inappropriately jumped in to debate Trump, telling him, \u201cThere is no state in this country where it is legal to kill a baby after it\u2019s born.\u201d She is incorrect.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Colorado, Michigan, and California have all recently&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/abortion-after-birth-language-laws-might-allow\/\" target=\"_blank\" rel=\"noreferrer noopener\">enacted<\/a>&nbsp;laws that include the term \u201cpregnancy outcomes.\u201d These states have moved to make abortion a \u201cright\u201d and allow women to make choices about abortion based on undefined \u201cpregnancy outcomes.\u201d The vague term could encompass situations like birth, miscarriage, abortion, and even death after birth.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Since these \u201coutcomes\u201d are not defined, a post-birth death that is caused deliberately or even by negligence&nbsp;<em>is not excluded<\/em>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cUnder the rules proposed by this bill, if a child is delivered alive during an abortion the doctors are under no legal compulsion to provide standard medical care as they would in any other circumstance and attempt to preserve the child\u2019s life,\u201d&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/colorado-senate-abortion-limits-governor\/\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>&nbsp;Live Action\u2019s VP of Communications and Director of Government Affairs, Noah Brandt. \u201cMedical providers would listen to the mother\u2019s instructions, which could include not providing life-sustaining medical care to the child, which would lead to the child\u2019s death, which most reasonable people would consider infanticide.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In addition, just because it is illegal to kill a newborn baby doesn\u2019t mean it isn\u2019t happening and that abortion advocates don\u2019t support it. Abortionist Kermit Gosnell is in prison currently for actively killing babies who survived his abortion procedures. But he\u2019s not the only one to carry out such horrific acts.&nbsp;<a href=\"https:\/\/abortiondocs.org\/abortionists\/douglas-alan-karpen-do\/\" target=\"_blank\" rel=\"noreferrer noopener\">Douglas Karpen<\/a>&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/douglas-karpen-the-texas-gosnell\/\" target=\"_blank\" rel=\"noreferrer noopener\">has been called the \u201cTexas Gosnell,\u201d<\/a>&nbsp;with claims of infanticide being leveled against him. Abortion advocates will deny that abortion survivors exist at all,&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/abortion-survivors-not-pro-life-myth\/\" target=\"_blank\" rel=\"noreferrer noopener\">but they do<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">And what\u2019s worse, pro-abortion politicians have consistently\u00a0<a href=\"https:\/\/www.thune.senate.gov\/public\/index.cfm\/2024\/6\/democrats-block-thune-s-born-alive-abortion-survivors-protection-act\" target=\"_blank\" rel=\"noreferrer noopener\">voted down<\/a>\u00a0laws to protect abortion survivors from infanticide and medical neglect. Records\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/hundreds-babies-survived-abortions-underreported\/\" target=\"_blank\" rel=\"noreferrer noopener\">show<\/a>\u00a0that at least 220 children survived abortions from 1999-2023, in\u00a0<strong><em>eight states<\/em><\/strong>\u00a0alone. Since there are no federal abortion reporting requirements, and because only a handful of states even report abortion survivors, this number is likely much higher \u2014 and the fate of the infants is most often death by neglect (a decision to provide no life-sustaining care). Read more\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/abortion-after-birth-language-laws-might-allow\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Currently, according to the&nbsp;<a href=\"https:\/\/www.frc.org\/prolifemaps\" target=\"_blank\" rel=\"noreferrer noopener\">Family Research Council<\/a>&nbsp;(FRC), three states have repealed laws in place to protect children born alive during abortions from infanticide: Minnesota, Illinois, and New York. Ten other states offer no protections for babies who survive abortions: Vermont, Connecticut, New Jersey, Maryland, North Carolina, Colorado, New Mexico, Utah, Idaho, and Oregon. Meanwhile, California, Washington, Wyoming, Nebraska, Iowa, Wisconsin, Michigan, Mississippi, Georgia, South Carolina, Virginia, Massachusetts, Delaware, New Hampshire, Rhode Island, and Maine only offer weak protection for abortion survivors such as ensuring care is provided but not a hospitalization, reporting requirements, and\/or no penalties for the non-complying doctors. That\u2019s 29 states that fail to fully protect abortion survivors.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">As reported by FRC, \u201cThere is currently no federal requirement to provide medical care to an infant born alive following an abortion. The Born-Alive Survivors Protection Act, requiring abortionists and any healthcare practitioners present to \u2018exercise the same degree of professional skill, care, and diligence to preserve the life and health of the child as a reasonably diligent and conscientious health care practitioner would render to any other child born alive at the same gestational age\u2019 is an attempt to remedy this.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201c\u2026 The bill failed with forty-four Democrats opposing the life-saving legislation, including now Vice President Kamala Harris, who was a senator representing California at the time. In 2020, the bill failed again, with Harris voting against it a second time.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>LIE #3: Pro-life laws make it \u201ccriminal\u201d for a doctor to provide health care.<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\"><em><strong>Truth: No pro-life law prohibits legitimate health care.<\/strong><\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Harris claimed during the debate, \u201c\u2026\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/fact-check-trump-nationwide-abortion-ban\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump abortion bans<\/a>\u2026 make it criminal for a doctor or nurse to provide health care. In one state, it provides prison for life. I have talked with women around our country. You want to talk about, \u2018This is what people wanted?\u2019 Pregnant women who want to carry a pregnancy to term suffering from a miscarriage being denied care in an emergency room because the health care providers are afraid they might go to jail and she\u2019s bleeding out in a car in the parking lot. She didn\u2019t want that. Her husband didn\u2019t want that.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">None of the traumatic stories the media and abortion advocates have promoted in the last two years required induced abortion (intentional killing of a preborn child) as the standard of care for resolving the condition. Women are not being denied treatment for&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/texas-women-blame-pro-life-law-ectopic\/\" target=\"_blank\" rel=\"noreferrer noopener\">ectopic pregnancy<\/a>,&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/biggest-lies-abortion-industry-roe\/\" target=\"_blank\" rel=\"noreferrer noopener\">pregnancy complications<\/a>, or&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/obgyns-set-record-straight-miscarriage-treatment\/\" target=\"_blank\" rel=\"noreferrer noopener\">miscarriage<\/a>, as Harris claims, because of pro-life laws. These laws all hold exceptions for ectopic pregnancy and the life of the mother and&nbsp;<em>do not include miscarriage treatment<\/em>&nbsp;(such as the administration of a drug or a D&amp;C after the accidental death of a child in the womb) in their definitions of abortion.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">No woman who claims she was \u2018forced\u2019 to travel out of state for an abortion actually needed an induced abortion. Every story in the media of a woman denied a so-called \u2018medically necessary\u2019 abortion or \u2018forced\u2019 to travel for a \u2018medically necessary\u2019 abortion has been proven to be misleading and false.&nbsp;<em>No pregnancy complication requires the preborn baby to be deliberately killed<\/em>&nbsp;prior to an emergency delivery. Read more on that&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/npr-pro-life-neglect\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>,&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/abortion-denial-medical-neglect\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>, and&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/ap-blames-pro-life-negligence-admits-everywhere\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In addition, one story of a Texas woman allegedly denied miscarriage care was also proven to be inaccurate. Miscarriages are treated in pro-life states, but because of the lies being spread by pro-abortion media and politicians, women suffering miscarriage are being misled to believe that unless they are offered immediate, emergency surgery, that they are not receiving the standard of care for miscarriage. This is entirely false. Read more on that&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/5-facts-texas-radio-host-wife-miscarriage\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Pro-life laws ban one thing: the&nbsp;<em>direct and intentional killing of a preborn child<\/em>&nbsp;in which the&nbsp;<em>desired<\/em>&nbsp;result of the procedure is a dead baby.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>LIE #4: IVF treatment is unavailable under pro-life laws.<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\"><em><strong>Truth: No pro-life law prohibits IVF.<\/strong><\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size\">During the debate, Harris claimed, \u201cUnderstand what is happening under Donald Trump\u2019s abortion bans. Couples who pray and dream of having a family are being denied IVF treatments.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">This claim was born from a&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/alabama-supreme-court-embryos-children\/\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a>&nbsp;made by the Alabama Supreme Court (which had nothing whatsoever to do with any sort of \u201cabortion ban\u201d), which ruled in February that human embryos created via IVF are to be considered children&nbsp;<strong><em>under the state\u2019s Wrongful Death of a Minor Act<\/em><\/strong>. The ruling \u2014 in the case of parents suing over the destruction of their embryos \u2014 went no further than that, and stated that if embryos are destroyed in an IVF clinic by accident or without the permission of the parents, those parents are legally allowed to file a lawsuit under the Wrongful Death of a Minor Act.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It&nbsp;<em>did not give personhood to embryos<\/em>, and no fertility clinic in the state was told to cease operations.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Despite this, fertility clinics temporarily&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/alabama-fertility-clinics-halt-ivf\/\" target=\"_blank\" rel=\"noreferrer noopener\">ceased<\/a>&nbsp;IVF treatments while they determined if they could continue practicing IVF knowing the large number of embryos that are destroyed as a standard part of the IVF process.
