Their case has been on hold in anticipation of the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>&nbsp;ruling.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cWe are confident, as the case begins moving again, we will prevail,\u201d said Kansas Attorney General Kris Kobach. \u201cIt is likely that this case may end up back at the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>. It is a question of major national importance.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Last year, the states filed a complaint in the Northern District Court of Texas challenging the pill\u2019s approval for use further into pregnancy, its generic form and its dispense through the mail.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The states claim economic harm from the increase in chemical abortions because Medicaid recipients experiencing complications must visit emergency rooms.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">They say more women develop health issues that require emergency treatment or hospital stays after taking&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>&nbsp;than women who undergo surgical abortions.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThese higher complication rates, ER rates, and hospitalization rates for chemical abortions cause direct economic harms on Plaintiff States in several ways,\u201d said their complaint, noting costs related to public insurance and hospitals.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The federal government has not yet responded to the states\u2019 complaint.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The states\u2019 litigation was put on hold for months while the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>&nbsp;weighed an issue brought by pro-life doctors contesting the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA\u2019s<\/a>&nbsp;decisions.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA<\/a>&nbsp;first approved&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>&nbsp;in September 2000, during the Clinton administration, to terminate pregnancies up to seven weeks.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The pro-life doctors argued that&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>&nbsp;should never have been approved. They challenged recent&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA<\/a>&nbsp;changes allowing the pill to be mailed to patients without in-person doctor visits and to be used up to 10 weeks into pregnancy.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The doctors won at the lower court level, but the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>&nbsp;said they did not have legal standing or sufficient injury to sue. In a unanimous ruling, the justices said the doctors\u2019 moral objections to&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>&nbsp;may be valid but did not show sufficient legal injury.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cFor that reason, the federal courts are the wrong forum for addressing the plaintiffs\u2019 concerns about&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA\u2019s<\/a>&nbsp;actions,\u201d Justice Brett M. Kavanaugh wrote for the court.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Restrictions have been steadily easing since the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA<\/a>&nbsp;approved&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>. The drug is now used for nearly two-thirds of abortions in America, and the number of required in-person doctor\u2019s visits has been cut.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Biden administration said in court that the rules were relaxed after careful study to ensure they would not harm women\u2019s health.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The American Medical Association said&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>&nbsp;also is used in cases of miscarriage, and the restrictions made care for those women more difficult.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A federal judge considering the pro-life doctors\u2019 challenge found flaws in the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA\u2019s<\/a>&nbsp;process and ruled that the initial approval was illegal.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The 5th U.S. Circuit Court of Appeals narrowed that ruling. It said too much time had passed to challenge the initial approval, but more recent changes, such as distribution by mail and use later in pregnancy, could be challenged.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court\u2019s<\/a>&nbsp;decision voided those lower court findings.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Last week, the Society of Family Planning reported that the number of abortions during the first three months of this year was slightly higher than before the high court overturned Roe v. Wade in 2022.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The court\u2019s ruling in Dobbs v. Jackson Women\u2019s Health Organization returned jurisdiction over abortions to the states. Abortion bans and challenges to pro-choice policies followed.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Pro-life advocates see the states\u2019 pending complaint as an avenue to curtail the use of the abortion pill, which they say is putting women\u2019s lives at risk.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cTwo federal courts found the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA<\/a>&nbsp;likely violated the law and the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>&nbsp;did not rule on the merits of this case, but rather said the doctors who brought the litigation lacked standing. Those who care about women\u2019s health and safety will continue to fight to stop the Biden-Harris&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA<\/a>&nbsp;from putting their ideological commitment to abortion ahead of women\u2019s safety,\u201d said Katie Glenn Daniel, state policy director for Susan B. Anthony Pro-Life America.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Penny Nance, president of Concerned Women for America, said the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>&nbsp;never weighed in on the federal removal of regulations that were intended to protect women.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cIt merely ruled the doctors challenging the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA\u2019s<\/a>&nbsp;actions lacked standing. Well, the intervening states here clearly have standing to challenge the agency\u2019s actions, and we are hopeful that the justices will finally take a look at the troubling facts underlying this case,\u201d Ms. Nance said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThe&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA<\/a>&nbsp;label itself says that around 1 in 25 women who take chemical abortion drugs will end up in the emergency room. States have more than a legitimate interest to protect mothers and preborn children. Concerned Women for America members are praying that justice will be done in this case, and the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/food-and-drug-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA<\/a>&nbsp;will be held accountable for its reckless disregard of women\u2019s safety in its hasty and unnecessary approval of this dangerous drug regimen,\u201d she added.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Justice Department did not immediately respond to a request for comment about the states\u2019 action.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Attorney General Merrick Garland praised the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court\u2019s<\/a>&nbsp;June 13 decision to eliminate the pro-life doctors\u2019 challenge.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">He vowed to continue fighting to keep the&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/topics\/mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">mifepristone<\/a>&nbsp;drug available.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThe Department will continue to work tirelessly to protect and advance reproductive freedoms under federal law,\u201d Mr. Garland said. \u201cThe Department of Justice is committed to protecting reproductive freedom.
