Alliance for Hippocratic Medicine"},"content":{"rendered":"\n<p style=\"font-size:18px\"><strong><em>By:  <a href=\"https:\/\/fedsoc.org\/commentary\/fedsoc-blog\/of-beetles-and-babies-the-possible-futures-for-standing-after-fda-v-alliance-for-hippocratic-medicine\" target=\"_blank\" rel=\"noreferrer noopener\">Erik Baptist, originally published June 6, 2024, The Federalist Society<\/a><\/em><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\">The U.S. Supreme Court is poised to issue a decision in&nbsp;<em><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/food-and-drug-administration-v-alliance-for-hippocratic-medicine-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">FDA v. Alliance for Hippocratic Medicine<\/a><\/em>. The Court\u2019s decision could have a significant impact on lawsuits that challenge federal agency actions on a broad range of subjects\u2014from energy development projects to pesticide approvals.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In the FDA case, four pro-life medical associations and four individual doctors sued the FDA for its actions concerning abortion drugs. The FDA has argued that these medical professionals lack standing to sue the agency\u2014even assuming its actions removing abortion drug safeguards were unlawful and threatened women\u2019s health.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">So how does a case against the FDA over abortion drugs have anything to do with beetles?<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It started over thirty years ago when the U.S. Supreme Court issued the seminal standing decision&nbsp;<em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/504\/555\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lujan v. Defenders of Wildlife<\/a><\/em>. Writing for the Court, Justice Antonin Scalia stated that \u201c[i]t is clear that the person who observes or works with a particular animal threatened by a federal decision is facing perceptible harm\u201d and thus has standing to sue the government. Years later, Justice Scalia\u2019s majority opinion in&nbsp;<em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/555\/488\/\" target=\"_blank\" rel=\"noreferrer noopener\">Summers v. Earth Island Institute<\/a><\/em>&nbsp;doubled down on this standing doctrine when explaining that someone who wants to \u201cview[] the flora and fauna\u201d of a particular location has standing to sue.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Environmentalists have used this Supreme Court precedent to justify their standing when challenging federal agency actions across the country. For example, environmentalists successfully&nbsp;<a href=\"https:\/\/www.nrdc.org\/sites\/default\/files\/kxl-complaint-20190701.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">thwarted<\/a>&nbsp;the construction of the Keystone XL Pipeline by citing their \u201cprofessional, scientific, and aesthetic interests\u201d in the American burying beetle, which resided in the pipeline\u2019s proposed pathway.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">An environmental group was also allowed to&nbsp;<a href=\"https:\/\/casetext.com\/case\/conservation-law-found-v-ross-2\" target=\"_blank\" rel=\"noreferrer noopener\">sue<\/a>&nbsp;federal agencies because one of its whale-watching members experienced \u201cheartbreak\u201d when she learned about the death of a North Atlantic right whale. The federal government had opened the whales\u2019 feeding grounds to gillnet fishing gear, and this particular whale died \u201cfrom entanglement.\u201d Another group was similarly able to sue because one of its members was affected \u201cemotionally\u201d by the alleged increased endangerment of these whales, causing her \u201cheartache.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In yet another case, environmentalists relied on their members\u2019 \u201cscientific, professional, educational, recreational, aesthetic, moral, and spiritual interests\u201d to&nbsp;<a href=\"https:\/\/biologicaldiversity.org\/programs\/biodiversity\/pdfs\/dunes-sagebrush-lizard-filed-complaint-2022-05-19-cv-00387.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">sue<\/a>&nbsp;the federal government over its alleged failure to protect the dunes sagebrush lizard as a listed endangered species. The U.S. Fish and Wildlife Service settled with the environmentalists and recently&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/05\/20\/2024-11025\/endangered-and-threatened-wildlife-and-plants-endangered-species-status-for-the-dunes-sagebrush\" target=\"_blank\" rel=\"noreferrer noopener\">finalized<\/a>&nbsp;this listing. The oil and gas industry has&nbsp;<a href=\"https:\/\/oilprice.com\/Energy\/Energy-General\/Endangered-Lizard-Threatens-Oil-and-Gas-Development-in-the-Permian-Basin.html\" target=\"_blank\" rel=\"noreferrer noopener\">stated<\/a>&nbsp;that this listing substantially threatens production in the energy-rich Permian Basin of New Mexico and Texas.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The examples of these cases can go&nbsp;<a href=\"https:\/\/biologicaldiversity.org\/campaigns\/pesticides_reduction\/pdfs\/2024-01-12_First-Amended-and-Supplemental-ComplaintCV-22-00090-TUC-JCH.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">on<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/casetext.com\/case\/american-bottom-conservancy-v-us-army-corps\" target=\"_blank\" rel=\"noreferrer noopener\">on<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In the pending FDA challenge, the plaintiff doctors have alleged that the agency\u2019s actions\u2014which decreased the safeguards required for women taking the abortion drugs\u2014have increased the risk that women who take abortion drugs will end up in the emergency room with complications. This, in turn, causes the pro-life plaintiff OB-GYN hospitalists to divert from their desired professional goal of helping women bring new life into this world and participate in surgical interventions to treat abortion-drug complications. The doctors say it grieves them to see women harmed by the FDA\u2019s actions. Removing the remains of a baby from the mother also causes these doctors much heartache.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">One of the plaintiff OB-GYN hospitalists&nbsp;<a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/public\/2023-01\/Alliance-for-Hippocratic-Medicine-v-FDA-2022-11-18-Appendix-MPI.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;that when she \u201cmust perform surgery to deal with complications from chemical abortions, this takes attention away from .&nbsp;. . multiple laboring patients\u201d preparing to give birth. She has \u201ccared for at least a dozen women who have required surgery to remove retained pregnancy tissue after a chemical abortion.\u201d It is \u201cheartbreaking\u201d for her to watch the \u201csuffer[ing] caused by \u201c[u]nsupervised chemical abortion.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In both the environmental lawsuits and the pending FDA challenge, the plaintiffs seek to pursue their professional and personal interests, but the federal government\u2019s actions prevent them from doing so while causing them emotional harm.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The U.S. Court of Appeals for the Fifth Circuit found that the plaintiff doctors had standing to sue the FDA for multiple reasons. In a&nbsp;<a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/public\/2023-08\/Alliance-for-Hippocratic-Medicine-v-FDA-2023-08-16-5th-Circuit-Opinion.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">concurring opinion<\/a>, Judge James Ho identified an additional reason: \u201cI see no basis for allowing Article III standing based on aesthetic injury when it comes to animals and plants\u2014but not unborn human life.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">During oral argument in the Supreme Court, Justice Neil Gorsuch also appreciated this connection. He&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2023\/22-235_q8l1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a>&nbsp;the FDA how its argument fits with the Court\u2019s environmental law cases because \u201cwe\u2019ve got to find a way to stitch it all together.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In response, the FDA asserted that there was an \u201cattenuated link\u201d between the FDA\u2019s actions and the harm to the doctors. But the plaintiff doctors contend otherwise, having submitted agency records that show the FDA repeatedly&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-235\/301142\/20240222125412317_23-235%20%2023-236%20Brief%20for%20the%20Respondents.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">directed<\/a>&nbsp;women to emergency rooms and hospitals\u2014where the doctors work and treat women for abortion-drug complications.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In its&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-235\/298586\/20240123205548537_23-235tsUnitedStates.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">briefing<\/a>, the FDA also argued that the plaintiffs could not rely on statistical probability of future harm for&nbsp;<em>unnamed<\/em>&nbsp;association members. The plaintiffs\u2019&nbsp;<a href=\"https:\/\/dm1l19z832j5m.cloudfront.net\/2024-02\/FDA-v-Alliance-for-Hippocratic-Medicine-2024-02-22-SCOTUS-Opening-Brief_0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">response<\/a>&nbsp;pointed to the testimony of three&nbsp;<em>named<\/em>&nbsp;doctors\u2014one association member and two of the individual doctor plaintiffs\u2014who have each treated women for emergency medical conditions from abortion drugs a dozen times or more. The doctors couple this evidence with the FDA\u2019s admission that its data showed \u201cthere may be more frequent ED\/urgent care visits\u201d caused by its recent actions.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">As the Court held in&nbsp;<em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/549\/497\/\" target=\"_blank\" rel=\"noreferrer noopener\">Massachusetts v. EPA<\/a><\/em>, \u201c[e]ven a small probability of injury is sufficient . . . provided of course that the relief sought would, if granted, reduce the probability.\u201d This allowed an environmental association to&nbsp;<a href=\"https:\/\/casetext.com\/case\/conservation-law-found-v-ross-2\">sue<\/a>&nbsp;the federal government on behalf of a member who \u201chas never yet seen a right whale and is concerned by \u2018[a]nything that reduces the probability\u2019 of her seeing one.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">And the plaintiff doctors explain that restoring the safeguards that the FDA removed will likewise reduce the probability of their injuries.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Given its decades-old precedent, the Supreme Court must (1) find that the doctors can sue the FDA, (2) overrule its precedent, or (3) create a double standard. There are no other options.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Will the Court follow the latter course and privilege beetles over babies? Lizards over life? Or will the Court\u2019s decision constrain environmentalists from challenging federal agency actions over aesthetic and emotional injuries? Or, as the plaintiff doctors urge, will the Court apply its precedent in a consistent manner and find that they have standing to sue the FDA?
