The case is set to be heard on March 26, 2024.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The&nbsp;<a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/AHM-OpeningBrief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">brief<\/a>, filed in&nbsp;<em>Alliance for Hippocratic Medicine (AHM) v. Food and Drug Administration (FDA)<\/em>&nbsp;claimed that the \u201cFDA\u2019s removal of safeguards for abortion drugs was arbitrary, capricious, an abuse of discretion, and otherwise unlawful,\u201d the pro-life doctors and medical organizations claimed in their brief.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cFDA\u2019s precipitous decision to remove its \u2018longstanding, minimally burdensome\u2019 in-office visit\u2026was a textbook violation of the APA [Administrative Procedure Act],\u201d AHM wrote.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>History of Abortion Pill Approval and Conflicts<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">AHM originally sought to question the legitimacy of the 2000 approval of the abortion pill by the FDA. However, due to&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/supreme-court-three-states-plaintiffs-abortion-pill\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">previous decisions<\/a>&nbsp;in the case, arguments before the High Court will center around changes made by the FDA to the drug\u2019s REMS safety requirements in 2016 and 2021.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Mifepristone was&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/fda-abortion-pill-timeline-events\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">approved<\/a>&nbsp;by the FDA in 2000 to be prescribed in-person through the 7th week of pregnancy. In&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/fda-abortion-pill-timeline-events\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">2016<\/a>, the FDA&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/us-abortion-pill-lives-lost-adverse-obscured\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">removed requirements<\/a>&nbsp;that all non-fatal adverse events be reported. It also allowed the pill to be prescribed through the 10th week of pregnancy, removed the requirement that only physicians prescribe the drug, and no longer required women to take the first pill at the abortion facility.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In 2021, the Biden FDA eliminated the&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/fda-removes-abortion-pill-safety-protocols-drug\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">in-person dispensing requirement<\/a>&nbsp;and allowed for the abortion pill to be permanently&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/fda-permanently-loosens-abortion-pill-safety-measure\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">shipped by mail<\/a>. Then in 2023, the FDA further expanded access to&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/fda-retail-pharmacies-abortion-pills-prescription\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">allow retail pharmacies to dispense the drug<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Live Action News&nbsp;<a of interest<\/a>&nbsp;and an&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/tangled-web-money-deception-abortion-pill\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">incestuous funding trail<\/a>&nbsp;from the investors in U.S. abortion pill manufacturers Danco Laboratories and&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/generic-abortion-pill-genbiopro-nationwide-market\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\">GenBioPro<\/a>, whose own dollars have been funneled to various groups behind clinical trials and studies of the abortion pill, which claim it is both safe and effective.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In some instances, these studies have problematically been\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/study-author-mail-order-abortion-pill-paid\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">authored<\/a>\u00a0by\u00a0<em>people on the\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/media-abortion-experts-payroll-manufacturers\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">payroll<\/a>\u00a0of the abortion pill\u2019s manufacturers<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2016 and 2021 FDA changes<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">In 2016, the FDA chose to \u201celiminate the requirement that prescribers report all serious adverse events,\u201d AHM claimed, adding that \u201cfor 2016, FDA failed to consider a major aspect of the problem: \u2018the cumulative effect\u2019 of the interrelated changes.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">AHM added, \u201cThe agency, instead, noted that abortion-drug manufacturers \u2018report adverse events, including serious adverse events, to FDA\u2019\u2026 But FDA did not explain how these far-removed manufacturers would learn about adverse events from OB\/GYNs, hospitalists, and emergency-room doctors who are under no obligation to report,.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The FDA\u2019s 2016 changes, according to AHM, \u201cincreased the risk that more women taking abortion drugs will need emergency care\u201d in three ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">The FDA \u201cincreased the gestational-age limit from seven to ten weeks\u201d where the \u201c\u2018failure rate\u2019 climbs from roughly 2 to 7 percent, as confirmed by FDA\u2019s label.\u201d<\/li>\n\n\n\n<li class=\"has-medium-font-size\">The \u201cFDA\u2019s removal of the Day 14 in-person follow-up visit\u201d will \u201cnaturally result[] in more women report[ing] to the emergency room.\u2019\u201d<\/li>\n\n\n\n<li class=\"has-medium-font-size\">The FDA\u2019s decision to end the \u201crequirement that licensed doctors prescribe and provide ongoing care to women using abortion drug\u201d results as the FDA concedes in \u201cOB\/GYNs, OB\/GYN hospitalists, and emergency room doctors like Respondents \u2018who must manage the aftermath.\u2019\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">As recent as 2020, the FDA \u201cexplained that it had reviewed \u2018thousands of adverse events resulting from the use of Mifeprex,\u2019 determined that abortion drugs continue to cause \u2018serious risks for up to seven percent of patients,\u2019 and concluded that an in-office visit was \u2018necessary to mitigate [those] serious risks,\u2019\u201d the pro-life doctors claimed.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In essence, the \u201cFDA based its decision to remove the initial in-person visit on (1) adverse event reports and (2) published literature that the agency conceded was not adequate,\u201d the brief claimed. \u201cEqually problematic, FDA did not recognize that it had years before abandoned the requirement that mifepristone prescribers report nonfatal adverse events.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cAlso troubling is the agency\u2019s reliance on studies that included safety measures like ultrasound screenings and follow-up visits, even though those safeguards were not included in the approved regimen,\u201d the brief added.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In addition, AHM alleged, many of the studies FDA relied upon for 2021 changes showed evidence that women would likely rely on ERs to handle abortion pill complications.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"956\" height=\"501\" src=\"https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/1-Supreme-Ct-Docs-Image.png\" alt=\"\" class=\"wp-image-30459\" srcset=\"https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/1-Supreme-Ct-Docs-Image.png 956w, https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/1-Supreme-Ct-Docs-Image-300x157.png 300w, https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/1-Supreme-Ct-Docs-Image-768x402.png 768w\" sizes=\"auto, (max-width: 956px) 100vw, 956px\" \/><\/figure><\/div>\n\n\n<p class=\"has-medium-font-size\">\u201cHad FDA retained the safeguards that it called \u2018necessary\u2019 and \u2018minimally burdensome\u2019 just a few years ago, it could have prevented many of these emergency events,\u201d AHM alleged. \u201cFDA\u2019s 2021 action also violates the Comstock Act\u2026 That statute prohibits using \u2018the mails\u2019 to send any \u2018drug \u2026 advertised or described in a manner calculated to lead another to use or apply it for producing abortion.\u2019 18 U.S.C. 1461. It also forbids using a \u2018common carrier or interactive computer service\u2019 to ship \u2018any drug \u2026 designed, adapted, or intended for producing abortion.&#8217;\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Plaintiffs Are Harmed and Therefore Have Standing<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">\u201cAfter full briefing and argument, the Fifth Circuit held that Respondent doctors and associations have standing. The doctors suffer harm because they have no choice but to violate \u2018their conscience\u2019 by completing elective abortions in emergency situations and \u2018divert[ing] time and resources away\u2019 from their regular obstetrics practice when women present with abortion-drug complications,\u201d the AHM brief stated.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">AHM doctors have&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/doctors-fda-abortion-pill-decades-medical-negligence\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">testified<\/a>&nbsp;to treating women who took abortion drugs with severe complications \u2014 \u201cmany who presented to the emergency room.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cIn removing crucial safeguards for the use of abortion drugs, FDA expressly counted on OB\/GYN hospitalists and emergency-room doctors\u2014like Respondents\u2014to manage abortion-drug complications,\u201d AHM wrote. \u201cWhen faced with these emergencies, Respondents have no choice but to provide immediate treatment, even though this kind of participation in an elective abortion harms their consciences and injures them in other ways.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">They allege that the \u201cFDA\u2019s [own] data and the Doctors\u2019 testimony establish that Respondents face a \u2018substantial risk\u2019 of these injuries\u2026 and FDA\u2019s 2021 and 2016 actions increase that risk.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">According to AHM, while the FDA argues they do not have standing, the FDA relied on similar hospitals for clinical trials and published abortion pill studies. One of those was the University of California, a pro-abortion institution\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/bad-actors-money-trail-abortion-pill-corruption\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">heavily tied<\/a>\u00a0to abortion pill investors.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cFDA says Respondent doctors\u2019 harms are \u2018speculat[ive]\u2019 because Respondents do not prescribe abortion drugs\u2026 But prescribing the drugs isn\u2019t what increases Respondents\u2019 exposure. That harm results from FDA\u2019s removal of the safeguards. FDA\u2019s unlawful actions have left Respondent doctors \u2018to deal with preventable emergent and life-threatening situations\u2019\u201d AHM wrote. \u201cFDA\u2019s actions have forced Respondent doctors to witness and participate in the grisly process of treating abortion-drug complications\u2014retained fetal parts, heavy bleeding, severe infections\u2014causing the doctors mental, emotional, and spiritual distress.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Removing Abortion Pill Safety Regs by Design Sends Women to ER\u2019s<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">Live Action News&nbsp;<a href=\"https:\/\/www.liveaction.org\/news\/alert-er-docs-undiagnosed-ectopic-abortion-pill\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">previously<\/a>&nbsp;documented that even pro-abortion emergency room staff have warned that ER doctors may see abortion pill complications fron undiagnosed ectopic pregnancies.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">AHM contends in their brief before SCOTUS that \u201cOB\/GYNs, OB\/GYN hospitalists, and emergency-room physicians will often be called upon to treat abortion-drug complications,\u201d and AHM also contends that this \u201cis not a bug in FDA\u2019s abortion-drug plan but part of its very design. When the agency eliminated crucial safeguards in 2021 and 2016\u2014safeguards like the ongoing care of healthcare providers\u2014FDA justified their removal based on the availability of emergency-care coverage.\u201d<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"955\" height=\"469\" src=\"https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/2-Supreme-Ct-Docs-Image.png\" alt=\"\" class=\"wp-image-30460\" srcset=\"https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/2-Supreme-Ct-Docs-Image.png 955w, https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/2-Supreme-Ct-Docs-Image-300x147.png 300w, https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/2-Supreme-Ct-Docs-Image-768x377.png 768w\" sizes=\"auto, (max-width: 955px) 100vw, 955px\" \/><\/figure><\/div>\n\n\n<p class=\"has-medium-font-size\">Live Action News has documented multiple times that today, the profiteers of the deadly abortion pill regimen are flouting the FDA\u2019s safety regulations on the abortion pill. target=\"_blank\" rel=\"noreferrer noopener\">past<\/a>\u00a0FDA gestational limits, may not have the ability to properly\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/bad-actors-abortion-pill-fda-ectopic\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">rule out<\/a>\u00a0potentially deadly ectopic pregnancies as required, prescribe \u2018<a href=\"https:\/\/www.liveaction.org\/news\/virtual-abortion-pill-advance-provision-increase\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">advanced provision<\/a>\u2018 abortion pills to women who are\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/bad-actors-industry-abortion-pills-arent-pregnant\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">not even pregnant<\/a>, allow pharmacists to\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/pharmacists-prescribe-dispense-abortion-pill\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">prescribe<\/a>\u00a0the drug, and encourage women to\u00a0<a href=\"https:\/\/www.liveaction.org\/news\/bad-actors-conceal-abortion-pill-complications\/&amp;utm_medium=email&amp;utm_source=housefile&amp;utm_campaign=lan&amp;utm_content=LAN_blast\" target=\"_blank\" rel=\"noreferrer noopener\">lie<\/a>\u00a0about abortion pill complications and instead to report to emergency departments claiming they are experiencing a natural miscarriage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u2018One in 25\u2019 Abortion Pill Clients Could End up in ER<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">\u201cFDA has long recognized that emergency care is essential to handle abortion-drug complications; the agency\u2019s own numbers say that roughly one in 25 women who take mifepristone will end up in the emergency room; and Respondent doctors have testified to routinely treating women suffering abortion drug harm,\u201d the AHM brief claimed. \u201cFactor in that hundreds of thousands of women take abortion drugs each year in the United States, and that FDA\u2019s own data indicates that tens of thousands of them go to the emergency room, and Respondents easily establish a \u2018substantial risk\u2019 that these harms \u2018will occur\u2019 again.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">To justify that statistic, AHM wrote that the FDA has admitted that \u201c2.9 to 4.6 percent of women who take abortion drugs end up in the emergency room.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Alliance Defending Freedom (ADF) who is\u00a0<a href=\"https:\/\/adfmedia.org\/case\/us-food-and-drug-administration-v-alliance-hippocratic-medicine\" target=\"_blank\" rel=\"noreferrer noopener\">representing<\/a>\u00a0AHM, directed Live Action News to mifepristone\u2019s\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2023\/020687Orig1s026lbl.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">latest 2023 label,<\/a>\u00a0where in a table 2 entitled, \u201cSerious Adverse Reactions Reported in Women Following Administration of Mifepristone (oral) and Misoprostol (buccal) in U.S. and Non-U.S. Clinical Studies,\u201d the 2.9% \u2013 4.6% ER statistic is located.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"965\" height=\"669\" src=\"https:\/\/cincinnatirighttolife.org\/wp-content\/uploads\/2024\/02\/3-Supreme-Ct-Docs-Image.png\" alt=\"\" class=\"wp-image-30461\" as 7 percent of women will need surgery after taking mifepristone \u2018to stop bleeding\u2019 or to complete the abortion\u2026<\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><em>The label also warns that a prescriber must \u2018[e]xclude [ectopic pregnancy] before treatment,\u2019\u2026\u2019because some of the expected symptoms experienced with a medical abortion (abdominal pain, uterine bleeding) may be similar to those of a ruptured ectopic pregnancy.\u2019<\/em><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\"
